Terms and Conditions
TERMS AND CONDITIONS OF MEMBERSHIP
These Terms and Conditions (“Agreement”) govern membership and use of the facilities, services, and programs offered by Vector (“Vector,” “we,” “our,” or “us”). By registering for membership, purchasing services, or accessing the facilities through the Virtuagym platform, you agree to the following terms.
Membership Agreement
Membership at Vector grants the member (“Member,” “you,” or “your”) access to facilities, services, and programming according to the membership type purchased.
All memberships are personal, non-transferable, and may not be shared with another individual. Vector reserves the right to modify membership structures, services, programming, class schedules, instructors, pricing, and facility access as needed to operate the business effectively. Membership access is subject to facility rules and operating policies.
Health and Fitness Acknowledgment
By participating in activities at Vector, you acknowledge that physical exercise and athletic training involve inherent risks. Activities offered may include, but are not limited to: strength and resistance training, cardiovascular exercise, group fitness classes, Brazilian Jiu-Jitsu training, mobility and conditioning programs, open mat training or sparring, recovery, wellness, and medical services.
You represent that you are physically capable of participating in these activities and that you have no medical condition that would prevent safe participation. You are responsible for consulting with a qualified medical professional before beginning an exercise program if you have any medical concerns. Members should not participate in training if they have contagious illnesses, skin infections, or open wounds that could pose a risk to others. Vector staff may ask members to refrain from training until the condition is resolved.
Assumption of Risk and Liability Waiver
Participation in athletic training carries risks that cannot be completely eliminated. These risks may include, but are not limited to: muscle strains and sprains, ligament injuries, fractures or dislocations, head injuries, physical injury from contact with other participants, permanent disability, and death.
By using the facilities or participating in any activity at Vector, you voluntarily assume all risks associated with participation. To the fullest extent permitted by law, you release and hold harmless Vector and its owners, instructors, employees, contractors, agents, and representatives from claims or liabilities arising from participation in activities or use of the facilities, except where prohibited by applicable law.
Martial Arts Training and Contact Activities
Brazilian Jiu-Jitsu and other martial arts involve close physical contact and controlled sparring. Members participating in these activities acknowledge that physical contact with other participants is inherent to the sport
injuries may occur despite proper supervision and safety practices. Members agree to follow instructor guidance and safety rules at all times. Vector reserves the right to remove or restrict participation if a member behaves in an unsafe, reckless, or unsportsmanlike manner.
Open Mat and Unsupervised Training
Vector may provide designated open mat periods or unsupervised training times. During these sessions instructors may not be actively supervising training and participants are responsible for their own safety and conduct. Members who choose to train during open mat sessions voluntarily assume additional responsibility for managing their training intensity, partner selection, and safety. Vector is not responsible for injuries resulting from unsupervised training.
Membership Billing and Payments
Memberships may be billed on a recurring basis depending on the plan selected. By enrolling in a recurring membership, you authorize Vector to charge the payment method on file through the Virtuagym ot ONVO platform for: membership fees, applicable taxes, program or event registrations, and other authorized charges. Members are responsible for maintaining valid payment information. Vector reserves the right to suspend membership access for accounts with failed or overdue payments.
Cancellation and Membership Changes & Refunds
Membership cancellation policies depend on the specific membership plan selected. Unless otherwise stated in writing: cancellations must be submitted four weeks in advance, membership fees already paid are non-refundable, and membership access continues through the end of the current billing period.
Vector reserves the right to adjust pricing, membership offerings, or billing structures with reasonable notice.
Refund Policy Refunds are not issued for unused membership time. In case of service issues, contact support at info@vectorcostarica.com
Class Bookings, Appointments, and Events
Certain classes, private sessions, workshops, or events may require advance booking. Failure to attend a scheduled class, private session, or appointment without proper notice (minimum 12 hours in advance of scheduled activity) may result in forfeiture of the session and applicable cancellation or no-show fees. Vector reserves the right to change instructors, schedules, or class formats when necessary.
Guest Policy
Guests may be permitted at Vector at the discretion of management. Guest access may require advance registration, signing a liability waiver, and payment of a guest fee. Members are responsible for ensuring their guests comply with all facility rules. Vector reserves the right to deny or revoke guest access at any time.
Facility Rules and Member Conduct
Members agree to follow all facility rules and staff instructions. Expected conduct includes: treating staff and members with respect, using equipment safely and properly, returning equipment to its designated location, cleaning equipment after use, and maintaining proper hygiene standards, particularly for martial arts training.
For hygiene, safety, and community comfort, clean and appropriate attire and footwear must be worn at all times in the gym. During designated martial arts classes specific uniforms or training attire may apply.
Harassment, intimidation, discrimination, or unsafe conduct will not be tolerated. Vector reserves the right to address inappropriate behavior or attire, and may suspend or terminate membership without refund if a member violates facility policies or compromises the safety or comfort of others.
Equipment Use and Damage
Members are responsible for using equipment properly and according to posted instructions or staff guidance.
Members may be held financially responsible for damage caused to equipment or facilities resulting from misuse, negligence, and intentional damage. Members should immediately report damaged equipment to staff.
Injury Reporting
Members must promptly report any injury that occurs on the premises to a Vector staff member. Timely reporting allows Vector to respond appropriately and maintain safe facility conditions. Failure to report an injury may affect Vector’s ability to investigate the circumstances of the incident.
Personal Property
Members are responsible for their personal belongings while using the facility. Vector is not responsible for lost, stolen, or damaged items. Members are encouraged to use available storage areas and secure their belongings appropriately.
Equipment Use & Coaching Policy
Members may not accept compensation for personal training, coaching, or instruction provided to other members within the facility unless authorized by Vector. All coaching, personal training, and instructional services conducted at Vector must be approved and scheduled through Vector staff.
Photography, Filming, & Social Media Policy
Photography or video recording by members within the facility should be conducted respectfully and must not interfere with classes, training, or the privacy of other members. Members should obtain consent before recording others. Vector staff may ask members to stop recording if it disrupts the training environment or compromises member privacy.
Vector may occasionally take photographs or video recordings during classes, events, or activities.
By participating in activities at Vector, you grant permission for your image or likeness to be used for promotional, marketing, or educational purposes unless you notify Vector in writing that you wish to opt out.
Video Surveillance
For safety and security purposes, portions of the facility may be monitored by video surveillance. By entering the premises, members acknowledge and consent to the use of video monitoring systems. Video recordings may be used for security, safety, and operational purposes.
Minors
Members under the age of 18 must have a parent or legal guardian sign this Agreement on their behalf. The parent or guardian accepts responsibility for the minor’s participation and compliance with all facility rules.
Facility Access and Operating Hours
Facility access is subject to operating hours and scheduled programming. Vector reserves the right to temporarily close areas of the facility for maintenance, special events, private bookings, and safety reasons.
Member Feedback and Communication
Vector is committed to providing a positive experience for all members and guests. Members who have concerns, complaints, or feedback about the facility, services, staff, or other members are encouraged to communicate directly with Vector management so that issues can be addressed promptly and fairly.
Members agree to engage with Vector in good faith to resolve concerns before making public statements that could harm the reputation of the facility or its staff. Vector values honest feedback and will make reasonable efforts to investigate and address member concerns in a timely and professional manner.
Third Parties
Membership management is provided through the Virtuagym platform, which supplies the technology infrastructure necessary for the delivery and management of the Services. Payment processing for Vector’s services is performed by ONVO, an authorized payment processing provider. By using the Service, you acknowledge and agree that certain functionalities and all payment transactions are facilitated by these third-party providers and may be subject to their respective terms, conditions, and privacy policies.
Suspension or Termination of Membership
Vector reserves the right to suspend or terminate membership at its discretion if a member violates these Terms and Conditions, a member behaves in a manner that threatens safety or community standards, or payments are overdue. Termination under these circumstances may occur without refund.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Costa Rica. Any disputes arising from this Agreement shall be handled within the appropriate jurisdiction of Costa Rica.
Acceptance of Terms
By registering for membership, purchasing services, or participating in Vector activities, you confirm that you have read and understood these Terms and Conditions and that you voluntarily agree to be bound by them.
LIABILITY WAIVER AND ASSUMPTION OF RISK AGREEMENT
This Liability Waiver and Assumption of Risk Agreement (“Agreement”) applies to all individuals participating in activities at Vector (“Vector,” “we,” “our,” or “us”). By signing or electronically accepting this Agreement, you acknowledge and agree to the following:
Voluntary Participation
I understand that my participation in physical activities at Vector is entirely voluntary. Activities may include, but are not limited to, strength training, cardiovascular training, group fitness classes, Brazilian Jiu Jitsu, striking, open mat training, cold plunge, and other athletic programs, as well as sports massage, bodywork treatments, and other wellness and recovery-related services.
Acknowledgment of Inherent Risks
I recognize that participation in these activities carries inherent risks that cannot be eliminated, including, but not limited to: muscle strains and sprains; ligament, joint, or tendon injuries; fractures, dislocations, or concussions; injuries from contact with other participants; permanent disability or death.
I understand that Brazilian Jiu Jitsu and other contact sports involve close physical contact, which increases the risk of injury.
Assumption of Risk
I knowingly and voluntarily assume all risks associated with participation in activities at Vector. This includes risks arising from my own actions, the actions of other participants, or the condition of the training environment.
Cold Plunge
I recognize that severe injuries or death can occur during cold plunging. Potential injuries include, but are not limited to, heart failure, loss of consciousness, and stroke, and may be caused by extreme cold, condition of participants, equipment, or other factors. I knowingly and freely assume all such risks, both known and unknown, and I assume full responsibility for my participation.
Open Mat and Unsupervised Training
I understand that certain training times, including open mat sessions, may be unsupervised. I acknowledge that participation in these sessions carries additional risk and I voluntarily assume those risks.
Tap Early / Safety Culture (BJJ and Grappling)
I understand that submissions, locks, and other grappling techniques can cause serious injury if not released immediately. I agree to: tap early when caught in a submission or hold, respect my training partner’s taps immediately, and follow all instructor guidance regarding safety and technique.
I acknowledge that failure to follow this practice increases the risk of injury and I voluntarily accept that risk.
Release and Waiver of Liability
To the fullest extent permitted by law, I release, waive, and discharge Vector and its owners, instructors, employees, contractors, agents, and representatives from any and all claims, demands, causes of action, or liabilities for any injury, illness, damage, or death arising from participation in activities or use of the facilities.
This release does not apply to liability that cannot be waived under applicable law.
Responsibility for Safe Participation
I agree to follow all safety instructions provided by Vector staff and instructors, to train responsibly, and to stop any activity if I feel unsafe or at risk of injury.
Health Acknowledgment
I affirm that I am physically capable of participating in exercise and martial arts training and that I have consulted with a physician if I have any medical condition that may affect my ability to participate safely.
Minors
If the participant is under the age of 18, a parent or legal guardian must sign this Agreement on the minor’s behalf. The parent or guardian accepts responsibility for the minor’s participation and acknowledges the risks described above.
Acknowledgment and Agreement
By signing or electronically accepting this Agreement, I confirm that I have read and understood this Liability Waiver and Assumption of Risk Agreement, that I voluntarily assume the risks described, and that I release Vector from liability to the extent permitted by law.
